Unexplained Wealth – Process

Stage 1: Receive Report

Upon receiving reports or suspicious indicators of unexplained wealth, the Unexplained Wealth Unit initiates an investigation. Information is gathered from various sources, to establish a basis for further action.





Stage 2: Statutory Request

Following a thorough investigation, if there are reasonable grounds to suspect unexplained wealth, a statutory request is issued. This request demands a written explanation, through a statement under oath, from the respondent involved. A timeframe of 21 working days is provided for the respondent to provide their response.

Stage 3: Analyse Response

The respondent’s reply is meticulously analysed. Depending on the adequacy of the response, further clarification may be sought through a second statutory request. Alternatively, in cases of no response, the Unexplained Wealth Unit may pursue a disclosure order.



Stage 4: The Commission

A comprehensive analysis report is submitted to the Commission. The Commission deliberates on the findings and determines the appropriate course of action. This may involve closing the case if the response is deemed satisfactory or proceeding to apply for an Unexplained Wealth Order.


Stage 5: Unexplained Wealth Order

Where the Commission has reasonable grounds to suspect that a person has unexplained wealth, it shall make an application to a Judge for an Unexplained Wealth Order for the confiscation of that unexplained wealth.
