Unexplained Wealth Order (UWO) means an Order issued under section 119 of the FCC Act.
Application
The Commission shall make an application to a Judge for an UWO for confiscation of unexplained wealth where the Commission has reasonable grounds to suspect that a respondent has unexplained wealth.
Issue
Where the Commission makes an application for an Unexplained Wealth Order and a Judge is satisfied that the respondent has unexplained wealth, a Judge shall issue an Unexplained Wealth Order or an order for the payment of its monetary equivalent.
Enforcement
When an Unexplained Wealth Order takes effect, the property shall vest in the State.
The Commission shall dispose of any property confiscated under an Unexplained Wealth Order and shall deposit into the Recovered Assets Fund, the proceeds of any sale or disposition of confiscated property and any moneys recovered
